Law Enforcement Guidelines

This policy provides guidelines to law enforcement agencies seeking further information on platform content and the procedure for obtaining content. All requests must comply with these guidelines prior to the company disclosing content.

Urgent and Immediate Requests

Also referred to as “Exigent Circumstance” Requests

If there exists an emergency situation in which there is an urgent threat to life, health, or property, and nenos is in a position to prevent such a threat from occurring, law enforcement officials may email support@nenos.one to request a release of information. This request must include:

  • The username of the account

  • A clarifying statement that you are submitting an urgent request

  • The reasoning and nature behind the urgency (including but not limited to terrorism, suicidal actions, bomb threats, and human trafficking)

  • Specific content that is relevant to the request (including direct messages, essays, audio, video, and photos) and why receipt of this content would assist with mitigating the threat

  • Your name, position, and the office from which you are applying

  • Your government phone number, email address, and office mailing address

  • Your signature on the document

Please note that all urgent and immediate requests will be treated on a case-by-case basis, though we will always abide by applicable law. Law enforcement officials should request this information as soon as possible to provide time for nenos to review and potentially collect and send information. Once we approve a request, and unless otherwise agreed upon, you will receive a response for such content in electronic formatting that can be accessible on processing platforms such as TextEdit, Microsoft Word, and Notes. Permitted by law, we may seek reimbursement for costs associated with collecting such information.

We will not notify content creators of this request due to the nature of the request.

Requests to Remove Content

In addition to, or instead of  violating community standards, it is possible for content to violate applicable local, state, or federal laws. It is the policy for nenos to typically respect these laws and provide law enforcement agencies and government officials with the ability to have content removed that violates these laws.

If you believe that content violates your local, state, or federal law(s) please submit your request to legal@nenos.one with the following information:

  • The username of the account you would like to remove content from

  • Specify the content requested for removal and why you are requesting it

  • Specify the law(s) that you believe the content is in violation of

  • Your name, position, and the office from which you are applying

  • Your phone number, official government email address, and office mailing address

  • Your signature on the document

You may attach any court orders or other relevant legal documents in your email to support your request.

To respect our content creators, we will notify them if they are the subject of an information request, including a copy of any request, excluding circumstances in which we are legally prohibited from sharing this request (we require a time period in which this prohibition will lapse and we may notify the creator).

We will be transparent in any requests for the removal of content and our decision on removal. Every six (6) months, we will release a public report on all  government and law enforcement requests for content removal.

Requests for Content Preservation

When content is considered relevant in evidence-seeking or discovery as part of a judicial proceeding, law enforcement officials may request for this content to be preserved. When permitted legally, we will preserve these requests for a period of ninety (90) days but will not disclose them outside of required compliance with applicable law.

To request content preservation, you must send an email to support@nenos.one with the following information in the form of a PDF letter on official letterhead:

  • The username of the account to be preserved

  • Your name, position, and the office from which you are applying

  • Your phone number, email address, and office mailing address

  • Your signature on the document

If you require additional time for us to preserve content, you must submit a request at least seven (7) days in advance of the expiration of your original request. We cannot honor all extension requests. In your extension request, it must include all of the requirements of the original request, plus how many days you are requesting.

To respect our content creators, we will notify them if they are the subject of a content preservation request, including a copy of any request, excluding circumstances in which we are legally prohibited from sharing this request (we require a time period in which this prohibition will lapse and we may notify the creator). We will not notify subjects of information requests if doing so may undermine the legal proceeding, pose a threat to the creator or others, or be counterproductive to the circumstances, including threats to life, health, and property.

Requests for Account Information

To request private information, including communications, law enforcement officials must go through the proper legal channels.

To request specific content, such as direct messages, posts, photos, videos, and audio, we require a search warrant from a legal entity with jurisdiction over nenos. To request other non-public information, we require a court order or subpoena from a legal entity with jurisdiction over nenos.  Once we approve a request, and unless otherwise agreed upon, you will receive a response for such content in electronic formatting that can be accessible on processing platforms such as TextEdit, Microsoft Word, and Notes. Permitted by law, we may seek reimbursement for costs associated with collecting such information.

In any request for account information, the request must include the following:

  • The username of the account you are requesting information from

  • Specify the information requested and why you are requesting it (we are unable to honor requests that are unnecessarily broad, nonspecific, or vague)

  • Your name, position, and the office from which you are applying

  • Your phone number, email address, and office mailing address

  • Your signature on the document

To respect our content creators, we will notify them if they are the subject of an information request, including a copy of any request, excluding circumstances in which we are legally prohibited from sharing this request (we require a time period in which this prohibition will lapse and we may notify the creator).

We will not notify subjects of information requests if doing so may undermine the legal proceeding, pose a threat to the creator or others, or be counterproductive to the circumstances, including threats to life, health, and property.
